Terms and Conditions prior to Feb 07, 2017
This doesn’t apply to investments, but if you use me for consultancy work, the following terms apply –
(unless I’ve specifically agreed otherwise). Boring, but necessary:
(Notes in brackets aren’t part of the terms. Dates in brackets indicate when italics text following was added.)
Cancelled sessions at
Sessions aggregate incidental work where applicable. (This means I bill for related little bits of work done as part of each consultancy session).
Elective work paid by client consent only. (I occasionally do bits of work which I think need doing, without waiting to be asked. It’s not compulsory to pay for this work. It will usually be marked clearly on invoices)
Payment due upon presentation of invoice. Invoicing at end of first session and monthly thereafter.
Away-from home work is billed at min 2hrs increment, except by prior agreement.
Travelling expenses billed at. 45p/mile, £10/meal, parking, tolls, fares, etc. chargeable. Hotels chargeable, by prior agreement only. Expenses are approximated based on typical journey costs. Travel costs are not applied to London area.
UK phone call charges to client are absorbed.
Short breaks during working time are chargeable away from home only.
Meal breaks are not chargeable, except if taken in client’s presence.
Home working, correspondence, phone calls, and all meetings are all chargeable, except by prior agreement. (You’ll almost certainly get more work than you’re asked to pay for. I stop the clock whenever I take a break)
3rd party introductions are billed at a separate, premium rate by prior agreement – which may or may not be paid by supplier by agreements. Introductions not to be pursued without agreement. (Basically if you do a deal with one of my contacts, you’ve got to agree terms with me – and not cut me out. With service providers, I’ll often have an affiliate deal in place – but I choose suppliers on how good they are, not on who pays me most).
Hourly rate £100 unless otherwise agreed (Amended as follows 18/1/2012) Extended or conditional payment terms of 60 days or more are payable at a standard rate of £200/hr. All hourly invoices not settled within 60 days of billing are subject to the extended-terms £200/hr rate, regardless of any previously lower hourly rates.
(Amended as follows 28/12/2015) Payments are classed as any payment received in cleared funds 48hrs before work commences. Such payments are generally eligible for a rate of £85/hr. An additional pre-payment discount to £70/hr is available on sums paid either: up to 48hrs after the first ever booking is made; or for prepayment of any sum exceeding £1,000.
(Amended as follows 18/4/2012) Clients are fully responsible for session timings. No credit is offered for meeting overruns, client late arrival, interruptions, etc.
(Amended as follows 18/4/2012) Clients are to detail any intended restrictions on home working, such as maximum permitted hours, etc. In the absence of a breach of any stated restrictions, all hours worked on the account are billable.
Management of delinquent accounts charged at full consultancy rate, plus any incurred expenses. (So if people don’t pay, I don’t have to spend my time chasing them for free)
Billing queries to be registered within 7 days (So anyone who decides it would be cheaper not to pay me can’t come back 3 mths later and say ‘well we didn’t pay because your bill was wrong’ when that’s not actually the reason at all)
Andrew Lockley is a UK resident individual wholly responsible for his own tax affairs, and not registered for VAT.
Issuance of payment indicates acceptance of invoice without query (i.e. don’t pay with a rubber cheque and then expect to be able to argue about the bill later, like one client did)
All recommendations provided are an opinion only, and the client remains fully responsible for the decision to act on any advice given. (i.e don’t sue me if you do something I suggest and it doesn’t work out. It’s only a suggestion!)
Liability limited to outstanding balance
Unspent credit balance forfeit after 12mths
(Amended as follows 5/5/2015) No refunds of credit balances are available for any reason.
